IMPACTO Y DESAFÍOS DE LA INTELIGENCIA ARTIFICIAL EN LOS DERECHOS FUNDAMENTALES: UN ESTUDIO JURÍDICO Y ÉTICO
Son numerosos y continuos los avances tecnológicos que abruman a la sociedad moderna, adquiriendo un papel fundamental el desarrollo de la Inteligencia Artificial (IA) en todos los ámbitos, generando continuos debates sociales, políticos, culturales, y en especial, legales. Toma entonces un papel fundamental el derecho ante las afecciones a derechos que la IA puede producir.
Se realiza una recopilación de los hitos más importantes de la historia de la Inteligencia Artificial, hasta la actualidad. A continuación, se configura el marco teórico y legal que ha entrañado la IA en el marco nacional y comunitario, pasando por la reflexión necesaria sobre la personalidad de la IA. Finalmente, en el marco de los DDFF que reconoce la CE, se estudian algunos casos de afecciones a estos derechos.
The rapid and continuous technological advancements overwhelming modern society have placed Artificial Intelligence (AI) at the center of all fields, sparking ongoing social, political, cultural, and especially legal debates. Law thus plays a crucial role in addressing the potential infringements of rights caused by AI.
This study compiles the most significant milestones in the history of AI, from its origins to the present. It then outlines the theoretical and legal framework that AI has entailed at both national and community levels, including a necessary reflection on AI's legal personality. Finally, within the framework of fundamental rights recognized by the Spanish Constitution, the study examines specific cases where AI has affected these rights.
