HOMESCHOOLING Y ESCOLARIZACIÓN OBLIGATORIA EN ESPAÑA
La educación entendida como un periodo de escolarización obligatoria es un planteamiento arraigado en la sociedad y política española desde el siglo XX. El creciente interés social por la educación en casa como expresión de la libertad de educación consagrada en el artículo 27 de la Constitución Española, implica un llamamiento a tratar el tema con más profundidad. Comenzando por el análisis de la situación actual de la Ley Orgánica de Educación, la aplicación del homeschooling en el momento presente, la delimitación del derecho a la educación del artículo 27 de la Constitución Española, la visión jurisprudencial del Tribunal Constitucional sobre el homeschooling y las propuestas de reforma, forman el contenido del presente trabajo. La escasez de estudios sobre el homeschooling desde el punto de vista jurídico dota de gran interés a este trabajo, que pretende dar respuesta a las principales preguntas que se derivan de la aplicación de la educación en casa en el sistema jurídico español.
Education understood as a period of compulsory schooling is an approach rooted in Spanish society and politics since the 20th century. The growing social interest in home education as an expression of the freedom of education enshrined in Article 27 of the Spanish Constitution implies a call to address the issue in more depth. Beginning with the analysis of the current situation of the Organic Law on Education, the application of homeschooling at the present time, the delimitation of the right to education in article 27 of the Spanish Constitution, the jurisprudential vision of the Constitutional Court on homeschooling and proposals for reform form the content of the present work. The scarcity of studies on homeschooling from a legal point of view gives great interest to this work, which aims to answer the main questions arising from the application of homeschooling in the Spanish legal system.
