EL INTERÉS SUPERIOR DEL MENOR EN LAS RELACIONES Y VISITAS ENTRE HERMANOS: A PROPÓSITO DE LA STS 383/2025
El presente trabajo se centra en la postura del Tribunal Supremo, en la sentencia 383/2025, donde se discute el interés superior del menor en las relaciones entre hermanos, en este caso, entre dos hermanas, que tienen el padre en común, y la existencia o no de justa causa para impedir las relaciones personales entre ellas, teniendo en cuenta el interés en que se establezca la relación por parte de una de ellas, y al margen de la situación penal en la que se encuentra el progenitor común. Si a eso se une una situación de violencia familiar o violencia de género, el denominado interés superior de menor y las relaciones entre hermanos puede derivar en conflictos judiciales donde los hijos pueden tener unas consecuencias que no les corresponden por lo que hayan realizado sus padres. La citada sentencia manifiesta que ese interés que va más allá del interés de los progenitores, y que deben ser exonerados los hijos de cualquier tipo de culpa por lo que hayan hecho los progenitores, ya que no deben pagar “justos por pecadores”.
This paper focuses on the position of the Supreme Court in ruling 383/2025, which discusses the best interests of the child in sibling relationships, in this case, between two sisters who share a common father, and the existence or absence of just cause to prevent personal relationships between them, taking into account the interest in establishing the relationship on the part of one of them, and regardless of the criminal situation of the common parent. If a situation of domestic violence or gender-based violence is added to this, the so-called best interests of the child and sibling relationships can lead to legal conflicts where children may suffer consequences that are not theirs for what their parents have done. The aforementioned ruling states that this interest goes beyond the interest of the parents, and that the children must be exonerated from any type of blame for what their parents have done, since they should not have to pay "for the sins of the guilty."
